Minnesota Assisted Living Resident Bill of Rights

Every resident of a licensed assisted living facility in Minnesota has guaranteed legal rights under MN Statute 144G.41. These rights are provided to every resident upon admission and posted in the facility.

As a resident of a licensed assisted living facility in Minnesota, you have the following rights guaranteed by state law:

Dignity & Respect

  • The right to be treated with dignity, courtesy, and respect at all times regardless of age, disability, race, religion, gender, or sexual orientation
  • The right to be addressed by your preferred name and title
  • The right to privacy in your room, your communications, and your personal matters

Care & Services

  • The right to receive care and services that meet your individual assessed needs
  • The right to know about your care plan, participate in its development, and receive a written copy
  • The right to refuse any service or treatment without losing other services you are receiving
  • The right to receive hospice services while residing in the facility
  • The right to be free from unnecessary physical or chemical restraints
  • The right to be informed in advance of any change in room assignment or roommate

Freedom & Autonomy

  • The right to make decisions about your own daily life including what to wear, when to sleep, and what activities to participate in
  • The right to manage your own finances unless you have chosen to delegate this responsibility
  • The right to practice your religion or spiritual beliefs
  • The right to communicate freely with family, friends, legal representatives, and outside parties
  • The right to receive visitors of your choosing at reasonable hours
  • The right to send and receive unopened mail

Required by Law

Vulnerable Adult Protection

All staff at Abundance Home Care LLC are mandatory reporters under MN Statute 626.557. Any suspected abuse, neglect, or financial exploitation of a resident must be reported immediately.

What Is a Vulnerable Adult?

A vulnerable adult is any person 18 years of age or older who receives services from a licensed facility and whose ability to protect themselves from abuse or neglect may be impaired.

Types of Maltreatment

  • Physical abuse — hitting, restraining, or causing physical harm
  • Emotional abuse — threats, humiliation, or verbal harassment
  • Sexual abuse — any non-consensual sexual contact
  • Financial exploitation — unauthorized use of money or property
  • Neglect — failure to provide necessary care or services

Facility Policy

Electronic Monitoring Policy

Residents have the right to place an electronic monitoring device such as a camera or audio recorder in their private room under Minnesota law.

Your Right to Electronic Monitoring

Under MN Statute 144.6502, residents of licensed assisted living facilities have the right to conduct electronic monitoring of their own room. This includes cameras, audio recorders, and similar devices.

Requirements

  • Written notice must be provided to the facility before installation
  • Monitoring must be limited to the resident's own private room
  • Any roommates must provide written consent
  • The facility must post notice that electronic monitoring may be occurring
  • Recordings may only be used for the resident's health, safety, and welfare

📋 Uniform Assessment Tool — What Is It?

The Uniform Assessment Tool (also called the Uniform Service Planning Tool or USPT) is a standardized assessment required by Minnesota DHS for all residents receiving home and community-based waiver services, including Customized Living in assisted living facilities.

The assessment is completed by a qualified assessor (usually the county or a lead agency) and determines the level of care and services a person needs. It is the basis for the Resident's individualized Service Plan and Medicaid waiver funding authorization.

  • Who completes it: A qualified county assessor or lead agency assessor — not the facility
  • When it happens: Before or shortly after admission, and reviewed at least annually or after a significant change
  • What it covers: Functional abilities, health status, cognitive status, behavioral health, social supports, and service needs
  • Why it matters: The assessment determines what services are authorized and funded through the MA Waiver

What Is a Care Plan?

Every resident at Abundance Home Care LLC has an individualized care plan developed with input from the resident, family, and care team. It is reviewed and updated regularly.

What a Care Plan Includes

  • Personal care needs — bathing, dressing, grooming, mobility
  • Medication management schedule and instructions
  • Dietary needs and food preferences
  • Medical conditions and health monitoring requirements
  • Mental health and behavioral support needs
  • Social, recreational, and spiritual preferences
  • Emergency and evacuation procedures specific to the resident
  • Family communication preferences

Emergency Preparedness

Abundance Home Care LLC maintains a comprehensive emergency preparedness plan and conducts regular drills per MN Statute 144G and MN Rule 4659.

Emergency Procedures

  • Fire: Immediate evacuation to designated assembly area. Fire drills conducted per shift twice per year minimum.
  • Severe Weather: Shelter-in-place in interior rooms away from windows. Weather monitoring maintained.
  • Power Outage: Backup plans in place. Generator readiness checked regularly.
  • Medical Emergency: 911 called immediately. Staff trained in CPR and first aid.
  • Missing Resident: Immediate search and 911 notification protocol.

Medications are administered by trained staff in coordination with our facility pharmacy, Genoa Healthcare, and each resident's physician.

No Smoking Policy

Abundance Home Care LLC maintains a smoke-free environment in all indoor areas to protect the health and safety of all residents and staff.

Smoking Policy

  • Smoking and tobacco use is prohibited inside all facility buildings
  • This includes cigarettes, cigars, pipes, vaping, and e-cigarettes
  • Smoking is only permitted in designated outdoor areas if applicable
  • This policy applies to residents, staff, families, and all visitors
  • Violations may result in discharge per MN Statute 144G discharge procedures

Residents who wish to smoke should discuss this with the administrator prior to or during admission.

Assisted living in Minnesota is a licensed, residential care option for adults who need help with daily activities but do not require the level of care provided in a nursing home. It is regulated under Minnesota Statute 144G and licensed by the Minnesota Department of Health (MDH).

Choosing the right assisted living home is one of the most important decisions a family can make. Here are the key things to evaluate:

  • Licensing: Is the facility licensed by the Minnesota Department of Health? Ask to see the license. Abundance Home Care LLC holds active MDH licenses at both locations.
  • Staff Ratio: How many residents per staff member? Our homes maintain a 5:1 ratio — one of the lowest in the Twin Cities.

✅ Medicaid Waiver — We Accept It

Abundance Home Care LLC accepts residents funded through Minnesota Medicaid waiver programs. This means eligible individuals do not need to pay entirely out of pocket for care.

  • What is a Medicaid waiver? It is a state and federally funded program that helps eligible low-income individuals pay for home and community-based services including assisted living.
  • Who qualifies? Eligibility is based on income, assets, and level of care need. Contact your county social services or a case manager to apply.
  • How does it work at Abundance? Your case manager works directly with us to coordinate services and billing. We work with case managers at Fraser and other county organizations.
  • Do I need a case manager? Yes — a Medicaid waiver requires an assigned case manager who coordinates your care plan and services.

To be admitted to Abundance Home Care LLC a prospective resident must:

  • Be 18 years of age or older
  • Have care needs that can be safely and appropriately met within our facility
  • Complete a pre-admission assessment conducted by our team
  • Have a completed Uniform Service Planning Tool (USPT) if applicable
  • Sign a written assisted living contract per MN Statute 144G.50
  • Provide physician orders for all medications at time of admission

All employees, contractors, and volunteers who have direct contact with residents at Abundance Home Care LLC are required to pass a Minnesota Department of Human Services (DHS) background study before beginning work.

  • Background studies are initiated by the facility — not the employee
  • Results are processed by the Minnesota DHS Background Studies division
  • A prior criminal conviction does not automatically disqualify you
  • Certain violent or vulnerable adult-related offenses may result in disqualification
  • You have the right to request a reconsideration if disqualified
